5/28/2024- Our daughter, a college junior, flew to Italy over the weekend to start a summer semester. Air France was great. They let her board early and made an announcement that a passenger had an airborne nut allergy. Even mentioned the seat row. We couldn’t have asked for much more. Moments later, a passenger whipped out a bag of pistachios and started cracking away. She was across the aisle but on the SAME ROW!
I wonder– has anyone tested the legal liability of a fellow passenger who may have committed a tortious act after having been told publicly of a dangerous situation? Intentional/negligent infliction of emotional distress? Might have they committed a crime? Assault or attempted assault?
Our daughter was prepared to request a seat change but instead just put her mask on. Was very proud of her not making a scene. Fortunately, her pistachio allergy is not as severe as her allergy to peanut.
